TERMS AND CONDITIONS OF TRADE

The terms and conditions that apply depend on whether a student chooses to take weekly lessons or casual lessons.

The terms and conditions below refer to weekly lessons, but please download the terms and conditions for casual lessons if you are interested in these.

FEES
1. Fees are as set out below, dependent on your choice of tuition plan:
a. Platinum PLUS Plan: $60 per hour, one-on-one.
b. Platinum Plan: $55 per hour, one-on-one.
c. Gold Plan: $50 per hour, one-on-one.
d. Silver Plan: $35 per hour, per student.
e. Group Plan: $30 per 90 minutes, per student.
2. Tutorials occur at Christchurch City Public Libraries or University of Canterbury Libraries for no travel fee.
3. If you require the tutor to travel to your home or other convenient location within Christchurch City, an additional Travel Fee of $10 will also apply per tutorial.
4. If you require the tutor to travel to your home or other convenient location outside Christchurch City (e.g. Tai Tapu, Lincoln, Kaiapoi, Rangiora etc), an additional Travel Fee of $15-$20 will also apply per tutorial.
5. If 10 tutorials are booked and paid for in advance, a 10% discount rate will apply (including travel costs).
6. Prices may be subject to change, however 4 weeks advance warning will be given in writing.

PAYMENT
7. All fees are payable directly to AHeadStart Ltd by either cheque or direct banking.
8. No fees are to be paid directly to the tutor, whether by cash, cheque or direct banking.
9. AHeadStart Ltd requires payment in full, preferably before commencement of all tutorials. As such, AHeadStart Ltd will endeavour to prepare an invoice and email this to the client in advance of tutorials. Where this does not occur, an invoice will be prepared and emailed subsequent to tutorials.
10. All invoices for individual tutorials must be paid within 3 days of the date of the invoice, unless we agree or specify otherwise.
11. All invoices for 10-tutorial plans must be paid within 7 days of the date of the invoice, unless we agree or specify otherwise.
12. Unless expressly stated otherwise, all payments are inclusive of GST.

DEFAULT & CONSEQUENCES OF DEFAULT
13. Where an invoice is not paid by the due date, a reminder notice will be emailed, with payment required within 2 days.
14. Where an invoice is not paid following the reminder notice, we will charge 2.5% interest per month, compounding monthly. Interest will accrue until the date the invoice is paid in full.
15. Where an invoice is not paid within 30 days of the initial invoice, we may choose to recover outstanding amounts from you via a debt collection agency.
16. Where an invoice is not paid within 30 days of the initial invoice, we may choose to commence legal proceedings against you to recover the costs incurred in recovering outstanding amounts from you, including debt collection and legal fees.
17. Where total debt collection agency costs, legal and other costs arising from collection of any amount owing by you exceed the debt collection fee charged you agree that our debt collection agent is also entitled to recover those additional costs from you.

TUTORIALS
It is imperative that this section in particular must be clearly understood by both the parent/guardian, as well as the student.
18. Scheduled tutorials will occur weekly or casually as agreed prior, on the day, time and venue that is mutually convenient to the tutor and the student/parent/guardian.
19. The student/parent/guardian agrees to casual or weekly tutorials (tutorial status) in the AHeadStart Application Form. Tutorial status can be altered, with a minimum of 7 days notice.
20. Scheduled tutorials occur during secondary school terms, but may also be requested during term breaks and summer holidays.
21. Scheduled tutorials do not generally occur on public holidays, although students may have tutorials on these days if mutually agreed with the tutor.
22. Where a student is late or shortens a tutorial without advance notice full payment for the tutorial must still be made.
23. It is the responsibility of the parent or guardian to ensure that tuition that occurs in the students home occurs in a communal living area in the presence of a parent or guardian.

WEEKLY  TUTORIALS
24. Weekly tutorials are organized prior to the commencement of tuition. This has the advantage that AHeadStart Ltd will do its utmost to ensure that the same tutor and tutorial times will always be available.
25. One tutorial out of every 10 tutorials may be cancelled without charge. Payment will be required for any further tutorials missed. The missed tutorial must be paid before commencement of the following tutorial.
26. If cancellation of a tutorial occurs two times in a row scheduled tutorial time may not again be available. No exceptions.
27. Tutorials will continue until a mutually agreed termination date, which must be arranged a minimum of 7 days prior to the final tutorial.
28. Where 7 days notice of the date of the final tutorial is not given, payment for a further tutorial will be required.

RESCHEDULING WEEKLY TUTORIALS
29. Where a student/parent/guardian chooses to reschedule a pre-arranged tutorial, notice must be given either to the Director of AHeadStart Ltd, Melanie Coker, or directly to the tutor a minimum of 48 hours in advance.
30. If a tutorial is rescheduled less than 48 hours in advance, payment for the original tutorial is required, as well as the rescheduled tutorial, where this applies.
The only exceptions are:
a.  under circumstances where a medical certificate can be provided. In this case, payment for only the rescheduled tutorial will be required.
b. when this is the first tutorial in 10 where rescheduling has occurred in less than 48 hours.
31. Rescheduled tutorials must occur within a week prior to the following tutorial. For example, if weekly tutorials are on a Wednesday, a rescheduled tutorial must occur before the following Wednesday tutorial.
32. Tutorials can be rescheduled to any time mutually convenient to the student and tutor.

CANCELLATIONS WEEKLY TUTORIALS
33. Where a student chooses to cancel a pre-arranged tutorial, notice must be given either to the Director of AHeadStart Ltd, Melanie Coker, or directly to the tutor a minimum of 48 hours in advance.
34. If a tutorial is cancelled less than 48 hours in advance, payment for the tutorial is required.
The only exceptions are:
a.  under circumstances where a medical certificate can be provided.
b. when this is the first tutorial in 10 where a cancellation has occurred in less than 48 hours.

NON-ATTENDANCE
43. Where a student is unable to attend a tutorial at very short notice, it would be appreciated if the student/parent/guardian can immediately notify the tutor, or the Director of AHeadStart Ltd, Melanie Coker.
44. Where a student does not attend a pre-arranged tutorial, without 48 hours notice, the tutor will wait for 20 minutes at the pre-arranged location. Beyond this time the tutor will assume that the student is not coming, unless informed otherwise.
45. If a tutorial is not attended, the tutorial will be charged for. The only exception is under circumstances where a medical certificate can be provided.

WARRANTY
42. If you are not completely satisfied with the first tutorial with a tutor, you are under no obligation to continue with the same tutor.
43. At your request, at any stage, AHeadStart Ltd will do its utmost to arrange another more suitable tutor. This must be arranged 7 days prior, according to the conditions Section 35.
44. If you are not at all satisfied with the first tutorial with a tutor and believe the tutor is completely unsuitable for teaching purposes, your fees will be refunded and no more tutorials will be provided.

CANCELLATION IF 10 TUTORIALS ARE PAID IN ADVANCE
42. If 10 tutorials are booked and paid for in advance at 10% discount students are committed to continuing lessons till such time as either the NCEA exams/end-of-year school exams have occurred or the 10 tutorials have been completed.
43. If tutorials have ended due to the occurrence of the NCEA exams/end-of-year school exams and tutorials are still remaining, these may either
a.  be reimbursed; however, the 10% discount will no longer apply.
b. be carried over to the following academic year.
44. If tutorials are cancelled prior to the occurrence of the NCEA exams/end-of-year school exams and tutorials are still remaining no refund will be given.

ACADEMIC RESPONSIBILITY
45. AHeadStart Ltd strives to provide the best possible service. However, AHeadStart Ltd will not be held accountable or responsible for the academic success or lack thereof demonstrated by the student. Although AHeadStart Tuition will do everything in its power to help grades and skill sets improve, AHeadStart can offer no guarantee.

CHANGES

46. These terms and conditions of trade are subject to change. We reserve the right to change these terms of use from time to time by publishing the changed terms on this website:
http://www.aheadstart.co.nz/terms-and-conditions-xidc37980.html. You should review these terms of use periodically to be aware of such changes. Your continuing access or use of this service following such publication shall be deemed your acceptance of the revised terms of use.

LIABILITY
47. AHeadStart Ltd is not liable for any direct, incidental, consequential, indirect, special, punitive or similar damages arising out of use of its tutoring service, or any errors or omissions in the content of its materials. You, the student/parent/guardian, specifically waive any and all claims arising out of the use of this tutoring service.

48. AHeadStart Ltd strives to provide the best possible service, which includes keeping parents and students informed about special offers, NZQA news, and relevant information about NCEA. You, the student/parent/guardian agree to receive the AHeadStart Newsletter, in accordance with the Unsolicited Electronic Messages Act 2007.

COPYRIGHT
49. All materials AHeadStart Ltd creates in-house are copyright, and provided to the student specifically as an educational aid. You agree that you will not publish or distribute any portion of any materials without prior written permission from AHeadStart Ltd.
